Acceptable Use & Fair Usage Policy

This Acceptable Use & Fair Usage Policy (the "Policy") forms part of the PersonaCart Terms of Service and applies to every user of the PersonaCart platform (the "Platform"), operated by PersonaCart LLC. Capitalised terms have the meanings given in the Terms.
Breach of this Policy is a material breach of the Terms. We may act under Section 12 of the Terms — including immediate suspension or termination, without notice — for any breach or suspected breach.
1. Your Core Undertaking
You will use the Platform lawfully, honestly, and in a way that does not harm PersonaCart, other users, Buyers, or the public. You are responsible for everything done through your account and for the conduct of anyone you allow to use it.
2. Prohibited Conduct
You must not, and must not permit or encourage anyone else to:
- Use the Platform for any unlawful purpose, or in violation of any law, regulation, sanctions programme, court order, or payment-network rule applicable to you or your Buyers.
- Engage in fraud, deception, phishing, impersonation, identity theft, money laundering, terrorist financing, sanctions evasion, or the concealment of the true nature or ownership of a business.
- Misrepresent yourself, your business, your location, your products, your pricing, your endorsements, your reviews, or any earnings or results — including through fake testimonials, undisclosed paid endorsements, false scarcity, hidden charges, or misleading claims about outcomes.
- Infringe or misappropriate any patent, copyright, trademark, trade secret, right of publicity, moral right, or other right of any person, or sell counterfeit, pirated, or unlicensed goods or content. See our Copyright & DMCA Policy.
- Upload, distribute, or link to malware, ransomware, spyware, cryptominers, or any code intended to disrupt, damage, or gain unauthorised access to any system or data.
- Probe, scan, or test the vulnerability of the Platform, breach or circumvent any security or authentication measure, access any account, data, or area you are not authorised to access, or interfere with any other user's use of the Platform.
- Circumvent, disable, or attempt to exceed any plan limit, quota, rate limit, metering, paywall, geographic restriction, or access control, including by operating multiple accounts to obtain allowances intended for one.
- Scrape, crawl, harvest, index, or bulk-download the Platform or its data other than through interfaces we document for that purpose, or use automated means to create accounts or generate activity.
- Send unsolicited bulk email or messages, or send any message to a recipient who has not given the consent the law requires, or use purchased, scraped, harvested, or otherwise non-consented contact lists.
- Resell, sublicense, white-label, or provide the Platform to third parties as a service, or use it to build, train, or benchmark a competing product, except under a written agreement with us.
- Publish content that is unlawful, defamatory, harassing, hateful, threatening, or that promotes or facilitates violence, terrorism, self-harm, or discrimination against any protected group.
- Publish sexual content involving minors, or any child sexual abuse material — we report such material to law enforcement and to the National Center for Missing & Exploited Children, terminate immediately, and preserve records.
- Collect, store, or process personal data unlawfully, or handle payment card data outside our supported payment integrations.
- Take any action that imposes an unreasonable or disproportionate load on our infrastructure, or that degrades the Platform for other users.
3. Restricted and Prohibited Businesses
You may not use the Platform to offer, promote, or transact in:
- Illegal goods or services of any kind, or goods or services whose sale is restricted in the Buyer's jurisdiction where you do not hold the required licence.
- Controlled substances, cannabis and its derivatives where not lawful for both parties, tobacco and vaping products, prescription pharmaceuticals, and unapproved medical devices, treatments, or health claims.
- Weapons, ammunition, explosives, and their components or manufacturing instructions.
- Adult or sexually explicit content, and adult services, except where expressly permitted by us in writing and operated with legally compliant age verification, record-keeping, and payment-network approval.
- Gambling, betting, lotteries, sweepstakes, raffles, and games of chance for value, other than as expressly permitted by us in writing and licensed in every relevant jurisdiction.
- Financial products and services requiring licensing, including money transmission, currency exchange, lending, debt collection, credit repair, investment or trading advice or signals, cryptocurrency or token issuance, exchange, mining, or custody.
- Multi-level marketing, pyramid or Ponzi schemes, matrix or "gifting" programmes, "get rich quick" offerings, and any business whose revenue depends primarily on recruitment.
- Essay mills, academic-cheating services, fake documents or credentials, forged identification, and hacking or account-cracking services.
- Sale of personal data, contact lists, social-media engagement, followers, reviews, or ratings.
- Charitable or political fundraising without applicable registration and disclosures.
- Any business that our payment processors, card networks, or banking partners prohibit, restrict, or later decline to support.
This list is not exhaustive. We may add to it at any time, and we may decline, restrict, or discontinue service to any business or use case in our sole discretion, including where the risk of fraud, chargebacks, regulatory exposure, or reputational harm is, in our judgement, unacceptable — whether or not the activity appears above. Our acceptance of a business at signup is not an approval of it, is not legal advice, and does not prevent us from acting later.
4. Fair Usage — What "Unlimited" Means
Some plans describe an allowance as "unlimited" or do not state a number. "Unlimited" means unlimited for the normal, good-faith use of a single business operating within the intended purpose of the plan. It does not mean infinite, and it does not mean unmetered.
4.1 What is fair. Use is fair where it is consistent with how a typical customer on the same plan uses the Platform. We measure typical use over rolling periods and across comparable accounts.
4.2 What is not fair. Use is not fair — and we may act under Section 4.4 — where it:
- materially and persistently exceeds the usage of comparable accounts on the same plan;
- consumes storage, bandwidth, compute, AI processing, email or message volume, or API capacity in a way that degrades or threatens to degrade the Platform for others;
- is automated, scripted, or machine-generated at a scale a human business would not produce;
- serves more than one business, brand, or client from allowances sold for one, or resells the allowance in any form;
- is used to stockpile, warehouse, or hoard resources (including domains, storage, or credits) rather than to operate a live business;
- splits activity across multiple accounts to obtain allowances beyond a single plan; or
- is inconsistent with the plan's stated purpose.
4.3 Published limits. Where a numeric limit applies — for storage, AI credits, seats, domains, products, payment links, campaigns, automations, API requests, or anything else — the current limit for your plan is the one published on our pricing page and shown in your account. Those published limits are the authoritative statement of your entitlement and may be changed under Section 5.4 of the Terms. We may also apply technical rate limits, request quotas, file-size and file-type restrictions, and abuse protections that are not separately published, and we may adjust them at any time to protect the Platform.
4.4 What we may do. Where use is not fair, we may, at our sole discretion and with or without notice: contact you to discuss it; apply or reduce rate limits; throttle or queue processing; suspend specific features; require an upgrade to a plan that fits the usage; charge for overage at our then-current rates; or suspend or terminate the account under Section 12 of the Terms. We will normally contact you first where the usage is not causing immediate harm — but we are not required to.
4.5 No banked allowance. Unless we state otherwise in writing, periodic allowances (such as monthly AI credits or message sends) do not roll over, are not refundable, have no cash value, and are forfeited on downgrade, expiry, cancellation, or termination.
5. Storage, Retention, and Inactive Accounts
Storage allowances are for content actively used in your business on the Platform. The Platform is not a backup service, an archive, or a general-purpose file host, and you must keep your own copies of anything you cannot afford to lose.
We may, on reasonable notice, remove content that exceeds your storage allowance after you have had an opportunity to reduce it, and we may restrict uploads while an account is over its allowance. We may reclaim resources from, and after reasonable notice delete the data of, accounts on a free plan that have been inactive for an extended period.
6. Security Research
We welcome good-faith security research. If you believe you have found a vulnerability, report it to [email protected] before disclosing it to anyone else, do not access, modify, or exfiltrate any data that is not yours, do not degrade the service, and give us a reasonable opportunity to remediate. Research conducted within these bounds will not be treated as a breach of this Policy.
7. Reporting Abuse
To report a breach of this Policy, email [email protected] with the URL or account concerned and a description of the issue. For copyright complaints, follow our Copyright & DMCA Policy instead.
We investigate reports at our discretion. We are not obliged to investigate, to act, to explain any decision, or to inform you of the outcome, and any action we take in one case creates no obligation to take the same action in another.
8. Enforcement and Consequences
Where we determine, in our sole discretion, that this Policy has been or may have been breached, we may take any action we consider appropriate, including: removing or disabling content; disabling features; withholding, delaying, or reversing payouts and fee remittances; freezing an account pending investigation; requiring identity or business verification; suspending or terminating accounts and any related accounts; reporting to payment processors, card networks, regulators, or law enforcement; and pursuing any remedy available to us at law.
Amounts already paid are not refunded on termination for breach of this Policy. Nothing in this Policy limits any other right or remedy available to us under the Terms or at law.
9. Changes to This Policy
We may update this Policy at any time; the "Last Updated" date above will change. Material changes will be notified as described in Section 18 of the Terms. Continued use after a change takes effect constitutes acceptance.
